Open Listing or Exclusive? What Sellers in Escazú and Santa Ana Should Know

If you are selling a house in Escazú, Santa Ana or anywhere else in Costa Rica, the first thing an agent will ask for is an exclusive. Six months, sometimes a year, one agency, and their fee is owed whoever ends up finding the buyer — including you.

We don’t work that way. GAP takes open listings only. You can list with us and with every other agent in the valley at the same time, and the one who actually brings the buyer is the one who gets paid.

What the two arrangements actually mean

An exclusive listing — a closed listing — gives one agency the sole right to sell your property for a fixed period. If anyone sells it during that window, that agency earns the commission. If your neighbour’s cousin knocks on the door and buys it, the agency still earns. If you find the buyer yourself, in most contracts the agency still earns.

An open listing gives no one the sole right to anything. You can appoint as many agents as you like. Each one is competing to be the one who closes it, and only the one who does gets paid. If you sell it privately, nobody gets paid.

Why sellers here usually do better with an open listing

  • Effort has to be earned. On an exclusive, an agent’s payday is protected the moment the contract is signed. On an open listing it isn’t protected at all — the only way to earn is to produce a buyer before somebody else does. That changes how hard the phone gets worked.
  • More eyes. Five agencies with your property in front of their buyers beats one agency with it in a drawer.
  • You keep control. Unhappy with how it is being handled? Walk away. There is no term to run out and no penalty clause.
  • Nothing is owed until it sells. No listing fee, no marketing fee, no monthly charge. If it never sells, it never costs you anything.

The honest case for exclusives

We would rather tell you the whole picture. Exclusives do have a place. An agency that knows it will be paid can justify spending real money on a property — professional photography and video, drone work, print, paid campaigns, a launch event. On a large development or a trophy property, that spend can be worth more than the competition of an open listing. Some agencies are also better organised when they hold the file alone: one point of contact, one set of photos, one price in the market.

What you are trading away is leverage. Once it is signed, your agent’s income no longer depends on urgency, and if the property goes quiet for four months there is very little you can do about it.

What an open listing asks of you

Two things, and they are not difficult. Keep the price the same everywhere — nothing kills a sale faster than a buyer finding your house at three prices on three websites. And tell every agent when something changes: a price adjustment, a new roof, a tenant moving out, an offer under negotiation. We will keep our listing accurate as long as you keep us in the loop.

We write it up properly rather than posting four photos and a phone number: what the property is, what condition it is in, what the neighbourhood is actually like, and the numbers a buyer will ask for. We publish it in English and in Spanish, because a good half of the buyers in the Central Valley are searching in Spanish.
